These Terms of Service ("Terms") govern your use of the Run Pass Optics mobile application, website, and related services (collectively, the "Service"), operated by ROMA Innovations, LLC ("RPO," "we," "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.
1. What the Service Is (and Isn't)
Run Pass Optics provides sports analytics, statistics, AI-generated insights, and organizational tools for sports fans — including bet-idea drafting, private pick'em-style contests ("Grids"), and fantasy-league analysis.
RPO is not a sportsbook, casino, or gambling operator.
- No wagers are placed, accepted, or settled through the Service.
- No real-money prizes are offered, collected, or paid by RPO, including in Grids (see Section 6).
- Where the Service links to third-party sportsbooks, that handoff is for convenience only. Any wager you place is a transaction solely between you and that sportsbook, subject to its terms and to the laws of your jurisdiction. You are responsible for confirming that sports wagering is legal where you are and that you are of legal age to participate.
2. Informational Content — No Advice, No Guarantees
Statistics, projections, "RPO scores," edge indicators, EV/Kelly figures, AI-generated bet or lineup recommendations, and all similar content are informational and entertainment content only. They are not gambling, financial, or professional advice; they are probabilistic estimates that can be wrong. Past performance does not predict future results. You are solely responsible for decisions you make based on the Service, including any wagers placed with third parties.
AI-generated content may contain errors, omissions, or outdated information despite our validation systems. Always verify material facts (injuries, lines, start times) with authoritative sources before acting.
3. Eligibility and Accounts
- You must be at least 13 years old to use the Service.
- Betting-related features require confirmation that you are 18 or older. Users who do not confirm 18+ receive a version of the Service with betting features hidden.
- You agree to provide accurate account information and to keep your credentials secure. You are responsible for activity on your account.
- We may suspend or terminate accounts that violate these Terms (Section 12).
4. Subscriptions, Credits, and Purchases
- RPO Pro is an auto-renewing subscription ($17.99/month or $119.99/year) purchased through Apple's App Store. Payment is charged to your Apple ID. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Manage or cancel in your App Store account settings. Refunds are handled by Apple under Apple's policies.
- AI publish credits meter certain AI-generated artifacts. Pro subscriptions include a monthly credit allowance (with limited rollover); credit packs are one-time consumable purchases that do not expire and stack with any plan. Credits have no cash value, are non-transferable, and are forfeited on account termination for cause.
- Promotional credits (e.g., referral rewards) are discretionary, may be changed or discontinued, and have no cash value.
- Prices may change prospectively; changes never affect a subscription period you have already paid for.
5. Fair Use of AI Features
AI features are subject to fair-use limits (rate, volume, and spend caps) designed to keep the Service fast and affordable for everyone. Attempting to circumvent limits, automate requests, extract training data, or use the AI features to build a competing dataset or service is prohibited.
6. Grids (Private Matchups)
Grids are private, invite-only social matchups between friends.
- RPO charges no entry fee for Grids and pays no prizes. Scores and leaderboards are for bragging rights within your group.
- Any side arrangement between participants is solely between the participants; RPO is not a party to it, does not hold funds, and is not responsible for it. You are responsible for ensuring any such arrangement is lawful where you live.
- Grid commissioners control invitations. Don't invite people you don't know or use Grids to spam.
7. Third-Party Services and Data
The Service integrates with third parties, including fantasy platforms (e.g., Sleeper, ESPN), odds and sports-data providers, and sportsbooks. By connecting a fantasy league you authorize us to retrieve the associated league data on your behalf. Third-party services have their own terms; we are not responsible for their availability, accuracy, or conduct.
Run Pass Optics is not affiliated with, endorsed by, or sponsored by the NFL, NBA, MLS, any other league, team, players' association, fantasy platform, or sportsbook. Team and league names and marks are the property of their respective owners and are used for identification only.
8. User Content and Conduct
You retain rights to content you submit (e.g., grid names, usernames, shared cards) and grant us a worldwide, royalty-free license to host, display, and share it as needed to operate the Service (including share images and invite links you generate).
You agree not to: (a) break the law or facilitate underage or unlawful gambling; (b) harass or defraud other users; (c) impersonate others; (d) scrape, reverse-engineer, or bulk-extract data, odds, or analytics; (e) resell or commercially exploit the Service without our written consent; (f) interfere with the Service's operation or security.
9. Intellectual Property
The Service — including the RPO name and logo, app design, proprietary metrics (e.g., RPO scores and composite indices), software, and content we create — is owned by ROMA Innovations, LLC or its licensors and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes.
10. Responsible Play
If you or someone you know has a gambling problem, help is available: call or text 1-800-GAMBLER, or visit ncpgambling.org. Consider using the self-exclusion and deposit-limit tools offered by your sportsbook.
11. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DATA (INCLUDING ODDS, INJURY STATUSES, OR SCORES) IS ACCURATE, COMPLETE, OR CURRENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROMA INNOVATIONS, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING GAMBLING LOSSES, LOST PROFITS, OR LOST DATA — ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $50.
Some jurisdictions do not allow certain limitations; portions of this section may not apply to you.
12. Suspension and Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access (and forfeit promotional credits) if you materially violate these Terms, abuse fair-use limits, or use the Service unlawfully. Sections 2, 9, 11, 13, and 14 survive termination.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Venue for any dispute lies in the state or federal courts located in Stearns County, Minnesota, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced in-app or by email, and the "Effective date" above will change. Continued use after the effective date constitutes acceptance.
15. Apple App Store Terms
Your download of the app is also subject to Apple's standard licensed application terms. Apple is not a party to these Terms, is not responsible for the Service, and has no obligation to furnish maintenance or support.
