Your privacy is important to ROMA Innovations, LLC (“we,” “us,” and “our”). This Privacy Policy (“Privacy Policy”) describes the information, data collection, and other privacy practices for the Run Pass Optics mobile application and related services (collectively, the “App”). This Privacy Policy addresses, without limitation, what type of information is gathered and tracked, how the information is used, and with whom the information is shared. This Privacy Policy applies to all of your interactions with ROMA Innovations, LLC, such as when you use the App, sign up for notifications, or contact us for support.

By using our App or submitting your Personal Information (as defined below) to us by any means, you are giving your consent to our collection, use, and disclosure of your Personal Information as described in this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please exit the App and do not provide Personal Information to us.

What Information We Collect

This Privacy Policy applies to all information collected by or submitted to ROMA Innovations, LLC and third parties acting on its behalf. “Personal Information” is data that reasonably can be used to identify, relate to, or describe an individual, such as your name and email address. You do not need to provide us Personal Information to simply browse the App. However, we may collect certain Personal Information and information about your activities while using our App, as described below.

Information Collected Directly From You

When you use our App, we may collect information from you, including but not limited to, the following:

      • Your first and last name
      • Your email address
      • Responses to a brief survey at the initial login to help us define future build innovations and improve the user experience

    Information Collected Automatically

    As you use and access our App, we and our service providers (which are third-party companies that work on our behalf to provide and enhance the App) may use a variety of technologies to automatically collect information, including but not limited to:

        • Usage Information: We collect usage data, such as the source address from which a request originates (e.g., your IP address), date and time of the request, and other parameters in the URL. This information is stored in log files and used for aggregated and statistical reporting. It is not attributed to you as an individual.

        • Interaction Data: We collect data on how you interact with the App, including which features you use most frequently, to better understand usage patterns and enhance the user experience.

      Use of Personal Information

      ROMA Innovations, LLC collects and uses Personal Information to operate and improve the App and deliver the services or carry out the transactions you have requested. These uses may include providing you with more effective customer service, making the App easier to use by eliminating the need for you to repeatedly enter the same information, performing research and analysis aimed at improving our services and technologies, and personalizing the content and features offered to you.

      Specific circumstances may include when:

          • You create a user account on the App
          • You participate in surveys and evaluations
          • You submit questions or comments to us

        We may also use your Personal Information to communicate with you. We may send you necessary service communications such as welcome messages and information on service issues. Personal Information collected through the App may be stored and processed in the United States, and by using the App, you consent to any such transfer of information.

        Sharing With Third Parties

            • No Data Sharing: We do not share your Personal Information with third parties except as necessary to provide the App or comply with legal obligations.

          Data Storage and Security

              • Data Storage Location: All data is stored on Google Firebase cloud services within the United States.

              • Data Retention: We retain your data until you delete your account. Upon account deletion, your information will be removed during our annual audit.

              • Security Measures: We recognize industry standards and employ security safeguards designed to protect your Personal Information from unauthorized access and misuse, including encryption and access controls. Regular security audits are conducted to ensure ongoing protection.

            User Rights

                • Right to Access: You have the right to request a copy of the Personal Information we hold about you.

                • Right to Correct: You can update or correct any inaccuracies in your Personal Information.

                • Right to Delete: You may request the deletion of your Personal Information at any time. Once your account is deleted, your data will be permanently removed during our annual audit.

                • Right to Restrict Processing: You can request that we limit the processing of your data under certain circumstances.

                • Right to Withdraw Consent: You can withdraw your consent to our data processing at any time by deleting your account or contacting us at support@runpassoptics.com.

              Account Deletion

              You can delete your account directly within the App. This will result in the deletion of all your Personal Information as part of our regular data management process.

              Children’s Privacy

              There are no age restrictions for using our App. However, we do not knowingly collect Personal Information from children under the age of 13 without parental consent.

              International Users

              Our App does not transfer data internationally. All data is managed and stored within the United States.

              Changes to This Privacy Policy

              We may update our Privacy Policy from time to time. When we do, we will notify you by posting the new policy on this page and providing a prominent in-app notification. For significant changes, we may also notify you via email. Your continued use of the App after the update signifies your acceptance of the revised Privacy Policy.

              Consent and Opt-Out Options

                  • User Consent: By using the App, you implicitly consent to the collection and use of your data as described in this policy.

                  • Opt-Out Options: We do not currently offer an opt-out option for data collection, as the data we collect is essential for the operation of the App.

                Dispute Resolution

                If you have any concerns or disputes regarding our privacy practices, please contact us first at support@runpassoptics.com. We will make every effort to resolve your complaint promptly and to your satisfaction. If the issue cannot be resolved internally, any unresolved disputes will be handled through binding arbitration under the rules of the American Arbitration Association, located in Minnesota, USA. This policy and any disputes related to it will be governed by the laws of Minnesota, without regard to its conflict of law principles.

If we do make material changes to this Privacy Policy, the revised Privacy Policy will be posted on this page, and we will post a notification of such changes in the App. Any use by you of the App after such changes shall conclusively be deemed to be your acceptance of such revisions. We encourage you to review this Privacy Policy periodically to be informed of any such revisions.
